Welcome to the Monox application or website/web by Telzar 019 International Communication Services Ltd. (“Telzar 019”), which is intended to allow the user to view information and perform various actions through the application or website (the “Application or website”).

By clicking the “I confirm” button, you confirm that you are above the age of 18 and that you have read and understood the terms of use and agree to and undertake to follow the terms of use in their entirety. If you do not consent to any of the terms of use, you must remove and delete the Application or website immediately from your mobile device and not use the Application or website, the content and/or the services provided through it in any way.

The terms of use are worded in masculine gender but apply to feminine gender too, mutatis mutandis. It is clarified that Telzar 019 will be allowed to change the terms of use at any time, and therefore you are required to read them frequently in order to check for and see changes. Your continued use of the Application or website, the content and/or services after a change in terms of use will indicate your consent to and acceptance of the updated terms of use. Use of the Application or website requires advance registration, providing personal information and receiving a username and password or any other means of identification that will be required from time to time (the “Information Security Means”). The username and password and/or any other means of identification or any of the Information Security Means that will be in effect from time to time are not to be disclosed to any other person. They are not to be kept in a place that is accessible to other persons, and are not to be delivered to any other party. Telzar 019 invests great efforts to protect against the risks posed by the Internet and cellular communication, to the extent that the protection against them is under its control. However, Telzar 019 does not have the ability to prevent and does not have control over preventing completely the insertion and action of malware and hostile parties in invading your privacy, eavesdropping on network traffic, hacking into databases, servers or computers of Telzar 019, impersonating the Application or website or Telzar 019, performing online frauds and scams, damaging or sabotaging the activity of the Application or website, the content and/or services. By using the Application or website, you declare that you are aware of the risks posed by using the Application or website, including as set forth above, and that you undertake to follow the directions above.

1. Within the Application or website, you will be able to receive, inter alia, access to online systems of third parties that have a license or permit to provide financial services as required by law for performing overseas money transfer actions (“access to financial service provider systems”); perform actions for purchasing products from the Telzar 019 store (“purchase actions”) and additional actions that Telzar 019 will allow in the future using the Application or website. If you are issued a payment card (the “Payment Card”) by Jerusalem Bank Ltd. (the “Bank”) that was marketed to you by Telzar 019, you will be able to view transactions that you performed using the Payment Card and the balance on the Payment Card, which will be reflected to you from the Bank’s systems (“viewing of Payment Card information”) and you will be able to report to the Bank the loss or theft of the Payment Card, thus blocking the use of the Payment Card (“reporting loss or theft of the Payment Card to the Bank”). As an integral part of the terms of use, you give your explicit consent to Telzar 019 to allow you access to the financial service provider systems, view using the Application or website information on the Payment Card and report to the Bank via the Application or website loss or theft of the Payment Card.

2. It is clarified that in all matters relating to viewing of information on the Payment Card and reporting loss or theft of the Payment Card to the Bank, Telzar 019 is only a connecting party between you and the Bank, and the information that will appear in the Application or website in relation to this will be information that will be reflected to you from the Bank’s systems. It should be emphasized that Telzar 019 has no control or effect over the correctness of the information, or control or effect over the availability or data from the Bank’s systems. Telzar 019 is and will not be responsible in any form or manner for direct or indirect damage, loss or expense that you may incur owing to your exposure to data that will be reflected to you via the Application or website from the Bank’s systems or in relation to the Bank’s actions in the case of reporting loss or theft of the Payment Card to the Bank through the Application or website. It is also clarified that the Bank will not be responsible for stops in the service and/or disruptions and/or faults and/or full or partial unavailability or inability to view the information on the Payment Card or report loss or theft of the Payment Card to the Bank via the Application or website.

3. It is also clarified that the Bank has no connection in any manner to access to the data of financial service providers and/or purchase transactions of products from the Telzar 019 store, or any other action that is not an action of viewing information on the Payment Card or reporting loss or theft of the Payment Card to the Bank as set forth, and that all actions that are not viewing of the information on the Payment Card or reporting loss or theft of the Payment Card to the Bank are performed independently and separately by and at the responsibility of Telzar 019, and the Bank is not and will not be responsible in any manner for the transfer of money abroad and/or for online clearing of the Payment Card or of any other card and/or for services and/or products and/or misuse and/or any direct or indirect damage, loss or expense that you may incur owing to the execution of actions through access to the systems of financial service providers and/or performing purchase transactions and/or any other transaction using the Application or website, which is not an action of viewing information on the Payment Card or reporting loss or theft of the Payment Card to the Bank.

4. In the case of stopping use of the Application or website, for any reason, or in the case of stops in the service and/or disruptions and/or faults and/or full or partial unavailability and/or inability to view information or report to the Bank via the Application or website, you will be able to view the data on transactions and balances for the Payment Card and report loss or theft of the Payment Card on the Bank’s website at the address: easyway.bankjerusalem.co.il

Purchase of products via the Telzar 019 store

As part of the services provided by Telzar 019 to all customers, Telzar 019 offers to its customers an opportunity to purchase products from the Telzar 019 store as set forth below. It is clarified that this service is being provided independently and separately by Telzar 019 and is not related in any manner to the Bank.

Limitation of use to personal, non-commercial purposes

5. Telzar 019 reserves the right not to honor and/or to cancel orders and/or purchases that in its humble opinion and at its discretion were made for commercial purposes, including who sale sales, retail sales or sales to any third parties, and it will take all legal measures available to it against parties that infringe on its rights. Telzar 019 reserves the exclusive right to deny you use of the Application or website, for any reason, even if you have used the Application or website previously, including for the following reasons, inter alia:
   1. You have provided erroneous information;
   2. An act or default that may cause damage to the Application or website and/or any third parties has been carried out;
   3. You have breached the terms of use;
   4. You have a debt to Telzar 019;
   5. You have used the Application or website to perform an act in contravention of law and/or in violation of provisions of law.

Price policy and payment methods

6. Telzar 019 reserves the right to change, at any time, the prices of the items and/or services shown in the Application or website, even without advance notice. The price that you are charged is the one stated in the Application or website at the time of making the purchase. The purchases on the Application or website may be done by sending an order through the Application or website and charging the card that use used by online clearing.

7. The prices stated in the Application or website include statutory VAT, if VAT payment applies.

8. Telzar 019 reserves its right, but is not obliged, to restrict the sales of its products or services to any person, geographic region or jurisdiction. Telzar 019 reserves its right to restrict the quality of each of the products or services offered by it. Any description of products or pricing of products will be subject to changes at any time and without advance notice, at its sole discretion. Telzar 019 reserves the right to stop offering you any product at any time.

Availability of the items

9. Items and services stated in the Application or website will be provided by Telzar 019 on the condition that they are still available / in stock at Telzar 019. Telzar 019 reserves its right to terminate, at any time and without sending advance notice, the marketing of any item and/or its offer to purchase and you waive any argument and/or demand and/or claim in this regard. If and do the extent that it will not be possible to purchase the item being ordered, Telzar 019 will contact you and offer you the opportunity to place another order or cancel your original order.

Confirmation of order

10. After you have confirmed your order by using the “Send” option, your order will be transferred for execution. From the moment of confirmation of the order as set forth, the order may not be changed and/or cancelled by you. If the items are not in stock, despite appearing in the application or website, or the debit of the card that you have used has not been approved, Telzar 019 will not be required to supply the ordered item to you. In this case, an appropriate notice will be sent to you and the card that you used will not be debited.

Delivery regions

11. The products will be delivered by delivery to your address. Alternatively, you are allowed to pick up the products that have been purchased at one of Telzar 019’s branches, by advance arrangement.

12. Items whose consideration has been paid may be supplied in the territory of the State of Israel only (with respect to destinations that are subject to security sensitivity and/or restrictions, Telzar 019 reserves the right to arrange an alternative nearby delivery place and/or lengthen the delivery time). Separate payment will be charged for the delivery according to the destination and its updated price list as published on the Application or website.

Handling and delivery costs

13. Telzar 019 charges a processing and delivery fee for each shipment of products appearing in the Application or website. You must have an identifying credential and the payment means that you used to make the order and show them to the courier. This condition is essential for receiving the product, and failure to fulfill this condition may result in disruption in the delivery of the product.

Delivery time

14. Subject to the statements in these terms of use, Telzar 019 will provide the ordered item within 7 business days (not including Fridays and Saturdays and eves of religious holidays and religious holidays) from the time of approving the order. Telzar 019 will not be responsible for delays in the delivery of the items as a result of events that are not under its control.

15. Upon receiving the order, you are requested to check the content of the parcel carefully. If there are any differences between your order and the item that you have received, you are allowed to act as set forth in the product return and refund policy chapter.

Product return and refund policy

16. You are allowed to cancel the purchase of a product whose value is more than NIS 50, by writing to Telzar 019, subject to the provisions of the Consumer Protection Law, 5741-1981 (hereinafter: the “Consumer Protection Law”) and its regulations and the product return and/or replacement and service policy as described in the terms of use. In general, the transaction may be cancelled from the day of making the transaction to fourteen days from the day of receiving the product or from the day of receiving the document containing the transaction details stated in the Consumer Protection Law, less a cancellation fee at a rate of 5% of the transaction amount or NIS 100, whichever the lower. The cancellation of transactions by credit card may also result in another cancellation commission for clearing at a rate of an additional 2.5% to the cancellation fee. Only a credit voucher will be given against the return of a product costing less than NIS 50.

17. The results of cancelling the transaction will be as set forth in the Consumer Protection Law.

18. A product whose case has been damaged and/or that has been used and/or that is in an unfit state may not be returned. No exchange or return will be done without showing an invoice. No refund, exchange note or credit for purchasing another product may be received for products that have been supplied under an order by special size or requirements.

19. The consideration less the cancellation fee will be returned soon after the time of cancellation of the transaction, subject to returning the product as set forth above and in no later than seven business days, and will be done in accordance with the manner in which the payment for the purchase was made.

Product repair and warranty policy

20. A product will be sent for inspection and/or repair by the manufacturer, importer and/or marketer at the cost of a delivery and service fee of NIS 100 or 5% and according to the warranty period and warranty conditions of the manufacturer, importer and/or marketer. The warranty for products, their properties and quality are at the responsibility of the manufacturer, importer and/or marketer only and are not at the responsibility of Telzar 019.

A product that has been delivered for repair will be returned to the customer within not more than 60 business days from the day of delivery of the product for repair. The date indicated on the repair form will be considered as the delivery day. The repaired product will be returned to the customer only against providing a repair form and showing an identifying credential. Telzar 019 is not responsible for the quality of the repair or the service provided by the manufacturer, importer and/or marketer.

Intellectual property

21. Telzar 019 has all of the intellectual property rights, including copyrights, to any information and/or display and/or software as defined in the Computers Law, 5755-1995, which have been developed and/or designed and/or authored and/or created by and/or for Telzar 019 and/or whose rights have been transferred to Telzar 019 from a third party, including graphic design, trademark, icons and commercial secrets, as defined in the Copyrights Law, 5768-2008 and the Trademarks Ordinance [New Version] 5732-1972 and/or the provisions of any other act.

22. Telzar 019 grants you a personal, nontransferable license to use the Application or website that is limited only to receiving the services provided by the Application or website and subject to the current terms of use that are published by Telzar 019. You undertake not to perform any action that may constitute infringement of the rights and/or intellectual property of Telzar 019, including actions such as translating into other languages, reverse engineering, decompiling into high level language, restoration to assembly language, modification and/or derived art based on the Application or website and/or modify it in any manner.

Prohibited uses

23. In addition to other prohibitions stated in these terms of use, you are not allowed to use the Application or website and/or its contents: (A) for any illegal purpose; (B) to solicit other to commit or participate in any illegal acts; (C) to violate international, federal, county or state regulations, rules, laws or ordinances; (D) to infringe on intellectual property rights of Telzar 019 or others; (E) to harass, misuse, insult, offend, slander, defame, scorn, intimidate or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, nationality or disability; (F) to distribute false or misleading information; (G) to upload or transfer viruses or any other type of malicious code that will or may be used in any way to influence the functionality or operation of the Application or website; or (H) to collect or track personal information of others; (I) for any obscene or immoral purpose.

24. Without derogating from the entirety of the foregoing, you are not allowed to store and/or collect personally identifiable information that does not pertain exclusively to you; use the services provided by the application or website for downloading or copying information for other parties; use data mining and/or launch an automatic system, robots or other tools used for gathering information and extracting data of any kind for the Application or website or use the Telzar 019 services for sending direct mailing messages for any other commercial purposes.

25. Telzar 019 reserves the right to terminate your use of the Application or website owing to breach of any of the prohibited uses.

Limitation of liability

26. In no case will Telzar 019, its directors, officers, employees, related companies, agents, contractors, suppliers or service providers thereof be responsible for any direct, indirect, accidental, punitive, special or consequential harm, loss, claim or damage of any kind, including but not limited to loss of profits, loss of income, loss of savings, loss of data, costs of replacement or any other damage, if based on a contract, torts (including negligence), absolute or other liability that arises from any action that you have performed on the Application or website, or any claim related in any manner to your use on the Application or website, including but not limited to any error or omission of content or any loss or damage of any type that have been caused as a result of using the Application or website.

27. Telzar 019 does not guarantee continued, ongoing access without infrastructure, communication or software interruptions or secure access to the Application or website, and you confirm that you are aware that in some cases you may not have access to the Application or website at all, whether in circumstances related to Telzar 019 or in circumstances that are not under its control, and you will not be entitled to any refund or compensation from Telzar 019 for any temporary difficulty in accessing the Application or website. In addition, Telzar 019 does not warrant, represent or declare that the Application or website and the various elements of the Application or website are free of errors, defects or flaws.

28. Telzar 019 does not warrant that the Application or website will run on every smartphone device existing in the market and/or on every smartphone device that will be marketed and used by end users and/or any other third party. You hereby exempt Telzar 019 of any liability for unsuitability of the Application or website for your cellular device.

Privacy policy

29. In this privacy policy, the term “personal information” means any information that has been gathered by Telzar 019 or by its agents, or given by you to Telzar 019, and which may be used to identify you. Personal information may include first name and last name, home address, email address, mobile phone number, age, sex and in certain circumstances information about location. It is hereby clarified that the personal information will not include any information in relation to viewing of information on transactions that you have performed with the Payment Card and on the balance existing on the Payment Card that will be reflected to you from the Bank’s systems and/or any information in relation to reporting to the Bank of loss or theft of the Payment Card.
30. The Application or website may collect information and statistics about users’ usage habits in relation to the services that are not viewing of information on the Payment Card or reporting loss or theft of the Payment Card to the Bank. The details that you voluntarily provide and the details that will be collected from you by your use of the Application or website will be kept in the database of Telzar 019 and will only be used in accordance with this privacy policy or the provisions of any law, for the purposes set forth below:
    1. To allow use of the services offered on the Application or website.
    2. To identify you during repeat logins to areas that require registration and to spare you from having to reenter your information each time.
    3. To improve and enrich the services and contents offered on the Application or website, including creating new services and contents that conform to the requirements and expectations of users and to change or cancel existing services or contents. The information that will be used by Telzar 019 to this end will be primarily standard information.
    4. To allow for adaptation of the services on the website to your preferences.
    5. To send you from time to time text or email messages on the services and products of Telzar 019. Such information will be sent to you only if you have given your explicit consent to this when registering for the application or website or in any other way. You will be able to withdraw your consent at any time and cease to receive email / text messages from Telzar 019.
    6. For contacting you when Telzar 019 considers it necessary.
    7. For the correct operation and development of the Application or website.
    8. For any other purpose set forth in this privacy policy or in the terms of use.
    9. You hereby declare that you are aware that Telzar 019 will be able to map your choices and use technological indicators known as cookies, among other indicators, which identify and save your preferences for improving your browsing speed and experience.
    10. If you object to gathering of information of this type about you, you can remove these indicators at your own initiative. You hereby declare that you are aware that removing these indicators will affect your speed and experience of using the Application or website and some of the Application or websites may fail to run properly or may be slower than usual.

Miscellaneous

30. To the extent that pictures appear in the Application or website, they are intended for illustration purposes only. There may be differences that arise from technical limitations between the product’s actual appearance and its appearance in a photograph.
31. The titles of the sections are intended for convenient and orientation purposes only, and will not be used for interpreting the terms of use.
32. No waiver, refrainment from action or giving of an extension by Telzar 019 will be considered as a waiver of its rights in accordance with these terms of use and/or statutory rights, nor will it constitute a precedent or apply to any other case, nor will it infringe on the right of Telzar 019 to exercise its rights at any time.
33. The invalidity of one or more of the conditions appearing above will not affect the validity of all of these terms of use. A condition that is invalid or unenforceable will be replaced with a valid condition that will be closest to the original condition that it replaces, to the extent possible by law.
34. Israeli law only will apply to the terms of use and any conflict arising from or related to use of the Application or website and/or content appearing therein and the jurisdiction for any matter related to or arising from the Application or website is conferred to the competent court in the State of Israel, in the Tel Aviv District only.
